Terms and Conditions

Identification and details of the responsible: Pombais, Produtos e Serviços em Meio Rural, Lda, with head office at Ninho de Empresas de Marvão, Gabinete 3, NIF 503639877 and with Tourist Accommodation License AL/1345 and RNAT registration 27/2022 .

At Pombais Turismo, we have an important responsibility and commitment regarding the security of our website and the protection of our customers' and visitors' data. Any changes to this policy will be made available here, in this statement.

 

TERMS OF USE

VILLAS

Reservation Conditions

To confirm the reservation, the guest must make the respective payment, in the amount of 50% of the reservation value as provided in the ad. 

The person who is responsible for booking the accommodation must provide the details that will appear on the invoice.

The guest will be subject to the cancellation and refund conditions as described in the booking engine. 

Cancellation during the stay may entail partial or full payment of the reservation, at the host's discretion. 

All prices include VAT at the legal rate in effect.

Payment Methods 

The reservation's payment can be made through the following methods

- Bank transfer to IBAN: PT50 0035 0228 00014445630 95;

- Cash at check-in to be agreed upon with the person who  responsible for the reservation;

- Debit/credit card;

Guests are also subject to the particular rules available in the accommodation advertisement.

 

Conditions of stay

The reservation holder must be at least 18 years of age and must remain in the booked accommodation for the entire stay. Guests under the age of 18 can only be accommodated if accompanied by an adult who is the reservation holder. '

Only people included in the reservation may stay in the apartment.

Pets are accepted upon request and may be subject to an additional fee as well as the payment of a security deposit, which will be refunded after the stay.

Smoking is not allowed inside the accommodation. 

No parties or events are allowed inside the accommodation. 

Under the terms of article 45.1 a) of the Convention implementing the Schengen Agreement, the accommodation of foreign citizens must be reported to the SEF, meaning all those who do not have Portuguese nationality.

Guests must notify the host of any damage to the accommodation, contents, equipment or accessories that occurs during their stay, even if the guest considers the damage to be regular wear and tear and not their fault. If the guest fails to notify the host of such damage they may be held liable for it.

The host is not responsible for any items left inside the accommodation after the guest has left. Any belongings found in the accommodation can be returned upon request. The guest is fully responsible for all expenses related to the process of returning their belongings.

 

House Key

In case of loss of the accommodation key, an additional fee of 50€ will be charged. 

 

Noise, Illegal Activity, Safety 

According to the law, the nightly rest period is between 10 pm and 8 am, so guests should maintain silence. 

Guests should not disturb their neighbors, including by making noise outside of the hours permitted by law. 

Reservations are not accepted for illegal or immoral activities. 

Guests are primarily responsible for their own safety during their stay.

 

Legislation and Unforeseen Events 

This agreement is between the guests and the host, who is duly authorized to arrange the rental of the accommodation. This agreement gives the guests an authorization to occupy the accommodation for the period and on the terms agreed upon. 

Guests are not tenants of the accommodation and do not have exclusive possession of it. 

In the rare event that a booked accommodation becomes unavailable due to damage caused by any circumstance not attributable to the host, such as nature phenomens, water or gas leaks, the host will not be responsible for the inconvenience caused, however, will take all necessary steps to move the guest to an accommodation with similar characteristics. 

The host reserves the right to update its terms and conditions at any time as necessary. 

These terms and conditions are subject to Portuguese law. The Portuguese Courts shall have exclusive jurisdiction in case of legal action relating to any booking.

 

 

RENTAL OF MATERIAL/EXPERIENCES

MATERIAL RENTAL TERMS AND CONDITIONS 

Point 1

The purpose of the present contract is to define the conditions and civil responsibilities of the clients who celebrate with the commercial company Pombais Experience, collective entity no. 503 639 877, hereinafter called Pombais, Produtos e Serviços em Meio Rural, Lda with registered office at Ninho de Empresas de Marvão, Gab. 3, 7330-215 - Santo António das Areias, Marvão, temporary contracts with a fixed term for rental and use of material for tourism activities. 

Point 2

This contract is valid and will take effect when signed by both parties. Its duration is valid only for the time of the material rental.

Point 3: Cancellation of a reservation

The cancellation of any reservation up to 48 hours before the beginning of the rental is free of charge. Any reservation cancelled less than 48 hours before the rental start date implies the loss in favor of Pombais Experience of the amount already paid as reservation.

Point 4: Mode of payment

The rental costs will be settled in cash upon signing of the contract.

Point 5: Penalties and miscellaneous expenses

In the event of deterioration, loss, theft or damage to the equipment, the customer must notify Pombais Experience immediately. The customer will be held responsible for any damage caused to the rented equipment and must compensate Pombais Experience for the amount necessary for its total recovery. 


INSURANCE

Point 6: Insurance

The rental of material to the customer includes, from the start, coverage by a Personal Accident and Third-Party Liability policy. 

GENERAL CONDITIONS

The customer is the user of the material, the individual on whose behalf the contract for use of the material will appear. Only customers are authorized to use the material and benefit from the terms of service.

In the execution of the present contract, the customer expressly and without any reservations acknowledges to be the sole responsible before the company Pombais Turismo, and will also be the sole responsible for all the amounts to be charged under the contract, as well as for the fulfillment of the conditions of membership and the resolution of the contract.

Title I: Object of the service

Pombais Experience undertakes to provide the customer with temporary use for predetermined periods by reserving the equipment that makes up its fleet and that is assigned to the pursuit of the purposes of this contract, under the terms of these General Conditions and the Particular Conditions. Delivery and collection of the equipment and accessories is carried out at Pombais Experience's premises. Delivery and collection of the material and accessories may also be carried out at a location previously agreed by the parties, which may incur an additional cost. 

Point 1: Membership conditions and suspension of the contract

  1. a) Acceptance by the rental company.

In order to benefit from the services related to the rental of the material and to the acceptance of Pombais Experience, the client must show the originals of the following documents:

- Valid identification document (such as Citizen Card, Identity Card, Passport...);

- Certificate from the Commercial Registry Office, in case it is a legal entity.

The registration of minors must be done by the person who legally represents them. Pombais Experience reserves the right to verify the accuracy of the documents delivered and to reject the acceptance of the proposal to those who, for example, show visible signs of drunkenness, are under the influence of drugs, as well as in case the individual suffers from any psychological disorder or physical disability that prevents the safe and correct use of the equipment.

The client must also hand in, at Pombais Experience's discretion, a deposit for the rental of the material, which will be returned upon delivery/collection of the bicycle and/or accessories as long as they are in the same conditions in which they were picked up/delivered.

 

Point 2: Material 

The rental contract applies to the material and/or accessories as defined in the particular conditions of the contract of which the customer acknowledges having had full knowledge.

The material is delivered in good working order with the structure in good condition, subject however to defects that are not visible and/or apparent. 

The customer undertakes to use the equipment by driving under the terms of the legislation in force and in accordance with the Highway Code, and may not circulate with it outside the territorial space of mainland Portugal.

It is not allowed to lend or otherwise cede the use of the material to any person not expressly authorized by the contract and/or by Pombais Experience. In any case, the client will remain responsible, in his capacity as contractor, for the amounts due and/or to be invoiced for the execution and/or termination of the present contract.  

Title II: Under the particular conditions

Point 3: Rental

The rental agreement must state the day, time and place of collection/delivery of the equipment, as well as the duration of the rental.

Title III: Journey

Point 4: Pickup and return of the material

Once the equipment has been picked up/delivered, it remains in the customer's custody, and the customer is entirely responsible for it and its accessories until it is returned to the same place where it was picked up or until it is collected from a place previously agreed with Pombais Experience.

If the customer finds when picking up and/or returning the material that it is not in working order, they must inform Pombais Experience immediately.

Point 5: Increase in the rental period (requested during the use of the equipment)

In case the client wishes to see the rental duration extended, he/she must contact Pombais Experience, asking for a change and waiting for the respective authorization.

Point 6: Delay in return 

The client must inform Pombais Experience of any and all delays that may hinder the return within the period established in the contract. The same period of delay will be due by the client according to the contractual tariff plus a penalty as foreseen in the particular conditions of the contract. In case of the delay is equal or superior to twenty-four hours, and not resulting from an express agreement between the parties, Pombais Experience reserves the right to file a complaint for theft against the client.

Point 7: Breakdowns, claims, incidents, degradation, theft or accidents 

In any of the cases mentioned above, occurring during the rental period, the client must contact Pombais Experience. Towing and repair expenses of the material in place, such as replacement of parts, will be at Pombais Experience's expense, provided it results from wear and tear or any normal circumstance inherent to the correct use of the material. In case of theft during the rental period, the client is fully responsible for the payment of the material, accessories and components. 

Title IV: Invoicing and Management

Point 8: Invoicing 

The rental taxes will be those in effect on the date the contract is signed, according to the modalities defined in the particular conditions of the contract.

The contract data will be the same data that will appear on the invoice. The invoice is issued after signing the contract and is subject to immediate payment.

Point 9: End of contract 

The end of the contract occurs automatically when the material and/or accessories rented by the client are returned to Pombais Experience or when they are collected by the latter, and the debts inherent to the rental contract, if any, are settled.

Point 10: Processing of personal data

All personal data collected by Pombais Experience are provided voluntarily and will not be transmitted to third parties unless authorized by the client to that effect, or in cases expressly referred to in contract.


TERMS AND CONDITIONS - EXPERIENCES

Object / Organization

Pombais Experienceis a registered trademark that identifies the activities organized and the services provided by Pombais, Produtos e Serviços em Meio Rural, Lda, NIF 503 639 877, holder of RNAAT License (National Register of Tourism Entertainment Agents) Nº 27/2022.

The conditions described below regulate the relationship between Pombais Experience and the person or entity acquiring the services provided by it. The registration in any of the activities presupposes the reading, knowledge and acceptance of the general conditions. The general conditions described, on this page, may be complemented by specific conditions sent to the client. By hiring Pombais Experience, the client recognizes and accepts all the Terms and Conditions established.

 

Liability / Insurance

- Civil Liability (Policy No. 206358980 - Allianz Portugal)

The company's professional activities are covered by civil liability insurance, which covers property damage and damage to property that may be attributed to us during the course of our activities, with an insured capital of 50,000 Euros.

- Accidents and Personal Accident Insurance (SAP)

All insurances held by Pombais can be activated during the period of time that the activity in which the customer has enrolled takes place. It is stipulated that this period of time begins on the date and time described in the activity and ends on the day and time the participant leaves the activity, even if he/she leaves it early and definitively or resumes it later. Whenever the client wishes to abandon an activity he/she must inform the guide of Pombais Experience of that.

All those accidents that occur as a result of the normal development of the activity described in the program in which the Client is participating or in any change introduced to it by Pombais Experience are considered as accidents that may trigger the SAP.

In the following circumstances, accidents will not be triggerable by SAP:

  • When the Client, on his or her own initiative, is doing any activity outside the normal development of the activity described in the program or following risk behavior that is unnecessary to the activity in which the client is participating;
  • When the Client, on his or her own initiative and against the indications of the Pombais Experience guide responsible for the field activity, decides to make changes to the route or program described and in which the Client is participating;
  • Should the Client decide to be accompanied by one or more dogs (2 at the most), any accident and/or incident occurring to the same(s) is the Client's entire and exclusive responsibility. Pombais Experience recommends, therefore, that the owner has an animal civil responsibility insurance, since Pombais Experience cannot be held responsible for it.

Any and all accidents that may trigger the SAP must be communicated to the Insurance Company, up to 48 hours after the conclusion of the activity in which the accident occurred.

Programming

The proposals and programs of the activities (price, location, difficulty level, detailed description, other information...) will be valid only for the dates presented. The participants of the activities must therefore be aware of the details of the respective activity.

The description of the activities presented on the Pombais Experience website and in the proposals sent to clients will be abbreviated but explicit. However, their content may be altered due to external factors related to the season and weather conditions.

Any changes to the program will be communicated to customers in a timely manner.


Schedule

The duration of the advertised activities is given as an indication and corresponds to an estimate, and may be subject to change depending on external factors to the guides - such as the configuration of the group and the diversity of its composition, changing weather conditions and terrain, unforeseen events. So, the indication of the finish time is approximate.

The schedules can be found on the Pombais Experience website or through social networks (Instagram and Facebook), or even in physical format by accessing a QR code that will take you to the schedule.

There is a 15-minute grace period, in reference to the time indicated for the beginning of the activity, for all participants to meet at the defined meeting point, for each activity.

 

Registration / Reservation / Payment

The reservations must be made, only and obligatorily, through the following means:

  • Fill out the online reservation form (please note that you will be asked for the following mandatory information when you register: name, date of birth, e-mail, and cell phone);
  • Through the social networks of the Pombais Experience- Instagram and Facebook (not exempting the fill in of the reservation form);
  • Payment for the activities will be made locally on the day of the activity to the guide, before the start of the activity, with exceptions to be agreed upon with the client;
  • In cases of activities involving local partners, or payments to third parties, payment must be made in advance, by bank transfer to the IBAN indicated and within the time period described in the e-mail you will receive in response to your reservation;
  • In case you need a receipt to be issued with your TIN number, this should be requested when paying for the activity.

When registering/reserving, the participant makes several commitments towards Pombais Experience:

  • Have taken note of and accept the present Terms and Conditions of participation, as well as the details of the activity in which the customer enrolls, which constitute the particular conditions of participation in the activity;
  • That you are in a state of health appropriate to the activity in question and accept the nature of the activity as well as the risks arising from the impossibility of immediate access to medical assistance;
  • That he/she is aware of the kind of physical and psychological demands that the activity may involve and that may lead to extreme and unforeseen situations;
  • Always communicate if you have a chronic illness or any other illness that prevents you from practicing this activity. If you have your doctor's permission to participate, you will need to provide us with a medical certificate.
 

Changes / Cancellations / Refunds

In case an activity needs to be cancelled for reasons beyond the control of Pombais Experience - extreme weather conditions, natural disasters - we will inform participants as soon as possible and a new reservation will be offered but always subject to the weather conditions of the respective day.

Pombais Experience reserves the right to cancel activities in the following cases:

  • There is not the minimum number of registrations for the activity to take place;
  • Weather or other conditions make it impractical;
  • The safety conditions that we consider necessary to carry out the activity are not met;
  • The conditions foreseen in the particular conditions are not met;
  • By force majeure the guides are unable to accompany the activity.

In case of cancellation of the reservation by the client, you may receive a full refund of your payment and under the following conditions:

  • For 1-day activities, if you cancel within 72 hours and if Pombais Experience, following the booking made, has not already made commitments to other partners/operators involved in the activity. Alternatively, you can nominate another participant to take your place, provided you do so up to 24 hours before the start of the activity.
 

Safety Standards

In the activities developed, Pombais Experience strictly complies with safety standards, reducing the risks associated with the performance of the same. However, participants should keep in mind that due to the nature of the activities performed, there is always some inherent risk that cannot be reduced in its entirety, so the participant should also adopt a preventive behavior.

Participants in the activities must comply with the appropriate rules of conduct and safety in order to ensure their own well-being and that of the group. Pombais Experience and its guides shall not be held responsible for inappropriate/inadequate behaviour of the participants, nor of their dogs during the activities, being able, however, to terminate an activity if safety conditions or rules of conduct are in question.

The participant is responsible for:

  • Accomplish and respect the instructions and information given to you by the organization, as well as respect the current regulations of all the visited places;
  • Respect the established schedules, as well as respect the other participants of the activity, whether they are guides or participants;
  • Ensure that you are in good health to perform the activities - some activities require the verification of certain conditions in the person performing them, such as minimum age, health status, and other physical and psychological requirements - and you should inform us in advance of any health problems or specific needs;
  • Respect the rules of conduct and good practices of visitors in protected areas - ICNF, ensuring the conservation of nature.
  • If you are accompanied by one or more dogs (2 at most), ensure that they are sociable and calm, and therefore do not represent an added destabilizing factor for the group. 
  • Ensure that the material used during the activity is taken care of and is returned as it was given at the beginning of the activity.
